Strengthening Cybersecurity Infrastructure: Exploring the Digital India Act Framework

In the rapidly evolving digital landscape, the need for robust cyber laws has become paramount. The existing Information Technology (IT) Act of 2000, enacted in the early days of the internet, no longer addresses the challenges and complexities of the present digital ecosystem. This modern legal framework aims to replace outdated provisions from the 19th-century British-era laws and can either complement or be integrated into the broader Digital India Bill. Additionally, the proposed legislation is expected to outline stringent penalties for offenders to ensure a secure and progressive digital environment.

The Need for the Digital India Act

The IT Act of 2000, which was formulated in a pre-Digital India era, lacks provisions to regulate modern internet-based services like e-commerce, social media platforms, and emerging technologies. Over the past two decades, India has witnessed a digital revolution and significant global advancements. The current regulatory landscape has become outdated and inadequate in addressing the challenges posed by the digital age.

Limitations of the IT Act 2000

The IT Act 2000 suffers from several limitations, which have prompted the need for an updated legislation like the Digital India Act 2023. Some of these limitations include:

  • Lack of comprehensive provisions on user rights, trust & safety.
  • Limited recognition of harms and new forms of cybercrimes, without any institutional mechanism for awareness creation.
  • Lack of distinct regulatory approaches for harmful and illegal content.
  • Absence of adequate regulations to address the regulatory requirements of emerging technology, technology, assessments of high risk automated automated-decision decision making systems , digital businesses including monopolies and duopolies.
  • Lack of adequate principles for data / privacy protection.
  • Lack of a converged, coordinated & harmonized institutional regulatory body; a dedicated and efficacious investigatory/ enforceability and a swift adjudicatory mechanism.
  • Lack of coordinated cyber security incident response mechanism.

The Goals of the Digital India Act 2023

The Digital India Act 2023 aims to achieve several key goals:

  1. Establish a Global Standard Cyber Law: The act seeks to be a catalyst and enabler for India's digital economy, striving to achieve a $1 trillion digital economy by 2025-26. It aims to accelerate innovation, manage internet complexities, ensure a safe and trusted internet, and protect citizens' rights.
  2. Foster Open Internet: The act aims to promote an open internet that facilitates choice, competition, fair market access, and ease of doing business for startups. It also safeguards innovation and emerging technologies.
  3. Ensure Online Safety and Trust: The legislation intends to adjudicate user harm cases, protect user rights, and regulate privacy-invasive devices. It seeks to address emerging forms of user harm, such as hate speech, disinformation, and fake news.
  4. Hold Intermediaries Accountable: The Digital India Act will provide a regulatory framework for different types of intermediaries, ensuring their accountability and responsiveness in protecting citizens' constitutional rights.

Way Forward

To draft a comprehensive and effective Digital India Act, a core team within the Ministry of Electronics and Information Technology (MEITY) will undertake a series of steps. This will involve a comparative study of global cyber laws, consultations with experts, industry stakeholders, and the general public. The goal is to create a dynamic and evolvable digital law that can keep up with market trends and technological advancements.

Digital India Goals 2026

The Digital India Goals 2026 are a set of ambitious but achievable goals that aim to make India a leading digital economy by 2026. The goals include creating a $1 trillion digital economy, making India a significant player in the global digital value chains, and ensuring that all Indians have access to digital infrastructure and services.

  • Create a $1 trillion digital economy by 2025-26. This would make India the third-largest digital economy in the world, after the United States and China.
  • Promote digital entrepreneurship and innovation. This would involve creating a supportive environment for startups and entrepreneurs to develop and grow their businesses.
  • India to be Shaping the Future of Technologies.
  • India to be a Significant Trusted Player in the Global Value Chains for Digital Products, Devices, Platforms and Solutions. This would involve developing India's own digital products and services, and becoming a major exporter of these to the world.
  • Use digital technology to improve governance and public services. This includes using e-governance platforms to make government services more efficient and accessible to citizens.
